Terms of Service

These Terms are an agreement between you and Tosh Development (“we”, “us”), the operator of Spades Ultimate at spadesultimate.com (the “Service”). By joining the waitlist, creating an account or playing, you agree to them. Please also read our Privacy Policy.

Who can play

You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service. You may not use it where doing so is against the law.

Your account

• One person, one account. Alternate accounts are not allowed.
• Keep your email secure: anyone with access to it can sign in with a sign-in code.
• Your player name must not impersonate anyone or be offensive. We may change or remove names that break these rules.
• Accounts are personal and may not be sold, shared or transferred.

Chips are for fun, never money

Chips and any other in-game items are virtual and exist only to play the game. They have no real-world value, can’t be exchanged, redeemed or “cashed out” for money or anything of value, and can’t be sold or traded outside the game. You don’t own chips; we grant you a limited license to use them in the Service. Winning chips is not winning money, and the Service is not gambling.

Chip purchases, when offered, are final once the chips are delivered to your account, except where the law gives you a right to a refund. If a purchase goes wrong, contact us and we’ll make it right.

Fair play

You agree not to:

• cheat, collude with other players, or play multiple accounts at the same table;
• move chips between accounts through deliberate losses, gifts or any other scheme;
• use bots, scripts or tools that play or give you an advantage;
• exploit bugs instead of reporting them;
• harass, threaten or abuse other players, or post hateful, sexual or illegal content;
• spam, advertise or sell anything through the Service.

We may review activity, remove content, reverse chips gained unfairly, and suspend or close accounts that break these rules. We act on reports and our own review, and a person makes any decision to restrict an account. If you believe we got it wrong, email us and we’ll take another look.

Suggestions and content you post

You keep ownership of what you post, like suggestions and chat. By posting it, you let us display it in the Service and use your ideas to improve the game, without owing you anything for them. Suggestions are screened before posting, including by automated tools, and we may decline, edit for length, merge duplicates or remove anything. Players who spam or misuse the suggestion board may lose access to it, the waitlist or the Service.

No ads

Spades Ultimate doesn’t show ads, and that’s our plan. As the Service grows we may need to revisit this; if we ever do, we’ll update these Terms and tell you before anything changes.

The Service may change

Spades Ultimate is new and still being built. Features, rules, chip amounts and prices may change, and the Service may occasionally be unavailable. We may end the waitlist or the Service; if we close the Service, we’ll give reasonable notice.

Disclaimers and limits

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties about it, and we aren’t liable for indirect or consequential damages, or for any loss of chips or in-game items. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you.

Changes to these Terms

We may update these Terms. We’ll change the date above and, for significant changes, tell you by email or on the site. Continuing to use the Service after changes take effect means you accept them.
